Terms and Conditions
Effective Date: [INSERT DATE]
Last Updated: [INSERT DATE]
These Terms and Conditions (the “Terms”) govern access to and use of https://snowpatrolllc.com/ (the “Website”) and communications initiated through the Website. The Website is operated for The Snow Patrol.
By using the Website, you agree to these Terms. If you do not agree, do not use the Website. These Terms do not, by themselves, require The Snow Patrol to accept a service request or create a service contract. Actual services, pricing, scheduling, scope, and other project-specific terms are subject to separate confirmation or agreement.
1. Services
The Snow Patrol provides information concerning the following approved services:
- Snow Plowing
- Deicing
- Commercial Snow Removal
- Emergency 24 Hr Service
- Snow Removal Management
Website descriptions are general information, not a promise that a particular service, schedule, response time, price, method, or result is available for every property or weather event. A website inquiry does not guarantee service availability or timing. Service eligibility, scope, pricing, and performance terms must be confirmed separately.
The Snow Patrol may update the Website’s presentation of its approved services. Any separate service agreement controls if it conflicts with general Website content or these Website Terms regarding a specific engagement.
2. User Obligations
When using the Website or communicating through it, you agree to:
- provide information that is accurate to the best of your knowledge;
- use the Website only for lawful purposes;
- avoid submitting content that is unlawful, deceptive, threatening, infringing, malicious, or unrelated to a legitimate inquiry;
- avoid interfering with the Website, attempting unauthorized access, introducing malicious code, or circumventing security controls; and
- avoid misusing, reproducing, reselling, or exploiting the Website or its content except as permitted by law or with prior written authorization.
You are responsible for ensuring that you are authorized to request information or services for the property or organization identified in your inquiry.
3. Payment Terms
The Website does not establish final prices, payment schedules, deposits, refunds, credits, or cancellation terms. If The Snow Patrol accepts a service request, applicable charges and payment requirements will be stated in a separate proposal, estimate, contract, invoice, or other written agreement.
You agree to pay charges that you separately authorize according to the governing written agreement. Nothing in these Terms creates a price, refund rule, financing offer, warranty, or payment obligation that has not been separately communicated and accepted.
4. Limitation of Liability
To the fullest extent permitted by applicable law, The Snow Patrol will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from access to, inability to use, or reliance on the Website.
The Website is provided on an “as available” basis for general information and service inquiries. The Snow Patrol does not warrant that Website access will always be uninterrupted, error-free, or free from harmful components.
Liability relating to separately contracted services is governed by the applicable service agreement and law. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
5. Intellectual Property
Unless otherwise stated, Website text, layout, graphics, branding, and other original content are owned by or licensed to The Snow Patrol and are protected by applicable intellectual-property laws.
You may view the Website for personal or internal business purposes connected with evaluating or requesting services. You may not reproduce, distribute, modify, publish, sell, create derivative works from, or commercially exploit protected Website content without permission, except where applicable law permits.
Third-party names, marks, or content remain the property of their respective owners.
6. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless The Snow Patrol from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful misuse of the Website, your violation of these Terms, or content you submit that infringes another person’s rights.
This section does not require indemnification for conduct by The Snow Patrol where such an obligation would be prohibited by law.
7. Termination
The Snow Patrol may restrict or terminate access to the Website when reasonably necessary to address unlawful activity, security threats, abuse, interference with Website operation, or a material violation of these Terms.
Termination of Website access does not, by itself, cancel or modify a separate service agreement. Any suspension, cancellation, or termination of separately contracted services is governed by that agreement and applicable law.
8. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules, except to the extent another law must apply.
Subject to applicable law, any court proceeding arising from or relating to these Terms or use of the Website must be brought in a court of competent jurisdiction located in Middlesex County, New Jersey. This venue provision does not prevent a claim from being heard in another forum when applicable law requires it.
9. Dispute Resolution
Before filing a court proceeding concerning these Terms or the Website, the parties should attempt in good faith to resolve the dispute through direct written communication, unless immediate relief is reasonably necessary or applicable law provides otherwise.
This section does not create mandatory arbitration, waive a right that cannot lawfully be waived, or prevent either party from seeking available relief in a court of competent jurisdiction.
10. Changes to Terms
The Snow Patrol may revise these Terms to reflect changes in the Website, applicable law, or business practices. Updated Terms will be posted with revised Effective Date and Last Updated fields when appropriate.
Changes apply prospectively from their effective date unless applicable law permits otherwise. Project-specific agreements already in effect remain governed by their own amendment and precedence provisions.
